When Do I Need To Get a Landlord Gas Safety Certificate?

If you are registered as a landlord and have at least one property with at least one tenant then you are legally responsible and should have a CP12 – Landlord Gas Safety Certificate to show that the property is Gas Safe.

You then have to get your Landlord Gas Safety Certificate renewed annually to ensure that the property remains Gas Safe each year to remain legally entitled to rent your property to any tenants.

If you have multiple properties then you need to have a Landlord Gas Safety Certificate for each one and again you will have to renew this each year for each property.

What Gets Tested In A Gas Safety Check?

What If The Landlord Gas Safety Certificate Is Not Issued?

If your property complies with all Gas Safety Standards and is deemed safe then a  Landlord Gas Safety Certificate will be issued right away by the Gas Safe Registered Engineer.

However, if you Gas Safety Inspections reports that any aspect of your property is not Gas Safe then the Landlord Gas Safety Certificate will not be issued and you will have to resolve the safety issues whatever they may be before a valid  Landlord Gas Safety Certificate can be issued.

If you are a landlord living at another address, this certificate can be sent to you or may be dealt with through your Letting Agent if you requested that.

What If The Tenant Doesn’t Allow Access For The Gas Safety Inspection To Be Carried Out?

It is the legal responsibility of the Landlord to ensure that there is a valid Landlord Gas Safety Certificate issued every year. Without this, the property CANNOT be legally rented to any tenants.

It is in the tenants best interests to have this Gas Safety Inspection carried out as it is intended for their safety. Therefore the Gas Safe Registered Engineer must be able to gain entry to the property in order to carry out the Gas Safety Inspection every year. New regulations allow the Gas Safety Inspection to be carried out up to 2 months prior to the expiry date of the last Landlord Gas Safety Certificate.

Who Gets The Landlord Gas Safety Certificate – The Tenant Or The Landlord?

The Landlord is ultimately responsible for the Landlord Gas Safety Certificate and as such can authorise this to go to whoever they want.

Often a copy of the Landlord Gas Safety Certificate is left with the tenant. However, if the Landlord specifically requests that the only copy should go to them then they still have to present a copy to the tenant within 28 days of the Landlord Gas Safety Certificate being issued.

Is There Anything Else That The Tenant Needs To Be Provided With?

As laws change over time and there are different laws in England, Wales and Ireland as there is in Scotland it is best to check with the various Government bodies to check what the updated regulations and requirements are.

What Other Certificates and Requirements Does a Landlord Need?

A Landlord’s Gas Safety certificate (CP12) – A legal requirement for any landlord in the UK and must be renewed every year.
